The Work Place Harassment and Violence Prevention Regulations, made pursuant to subsections 125(3) and 157(1) of the Canada Labour Code, aim to prevent and protect employees from harassment and violence in the workplace. The regulations apply to employees employed on ships, trains or aircraft, as well as those working in frontier lands involved in exploration or drilling for oil or gas.


The regulations require employers and their applicable partners to jointly carry out a work place assessment that identifies risk factors and develops preventive measures. Employers must also develop a work place harassment and violence prevention policy, which includes elements such as training, reporting procedures, and support measures. The policy must be made available to all employees and reviewed and updated annually.


Employers are responsible for providing training on workplace harassment and violence to employees, the designated recipient, and themselves. Training must include information on the work place harassment and violence prevention policy, recognizing, minimizing, preventing, and responding to harassment and violence.


The regulations also establish a resolution process for reporting incidents of harassment and violence. Employers must designate a person or work unit as the designated recipient to whom notice of an occurrence may be provided. Notice of an occurrence must contain specific information, including the name of the principal party and responding party, date of the occurrence, and a detailed description of the incident.


The regulations require employers to respond promptly to reports of harassment and violence, contacting the principal party within seven days after receiving notice. Employers must also review and update their work place assessment regularly to ensure that it remains accurate and effective.


Overall, the Work Place Harassment and Violence Prevention Regulations aim to create a safe and healthy work environment by requiring employers to take proactive steps to prevent and respond to harassment and violence in the workplace.
