Brief
THE REHABILITATION COUNCIL OF INDIA ACT, 1992
This Act provides for the constitution of the Rehabilitation Council of India for regulating and monitoring the training of rehabilitation professionals and personnel, promoting research in rehabilitation and special education, maintaining a Central Rehabilitation Register, and matters connected therewith or incidental thereto.
The Act defines various terms such as Chairperson, Council, handicapped, member, member-secretary, mental retardation, notification, prescribed, recognized rehabilitation qualifications, register, regulations, rehabilitation, rehabilitation professionals, and other related terms.
The Act provides for the constitution of the Rehabilitation Council of India with a Chairperson appointed by the Central Government from amongst persons having experience in administration and professional qualification in the field of rehabilitation, disabilities, and special education. The Council shall consist of members nominated by the Central Government from various Ministries and institutions dealing with matters relating to persons with disabilities.
The Act prescribes minimum standards of education required for granting recognized rehabilitation qualifications by Universities or institutions in India. It also provides for the registration of vocational instructors and personnel working in vocational rehabilitation centers under the Ministry of Labour on recommendation, and recognizes these centers as manpower development centers.
The Act empowers the Council to prescribe standards of professional conduct and etiquette, and a code of ethics for rehabilitation professionals. The Council may order removal of names from the Register if it is satisfied that such action is necessary due to error, misrepresentation, or suppression of material facts, conviction of an offense, or violation of standards.
The Act provides for the appeal against orders of removal from the Register and states that no appeal shall be admitted within sixty days from the date of the order. The Council must keep and maintain the Central Rehabilitation Register in accordance with this Act and any order made by the Council.
The Act requires the furnishing of reports, copies of minutes, abstracts of accounts, and other information to the Central Government as required. The Central Government may publish such information in a manner deemed fit.
