Brief
The Social Security Disability Benefits Reform Act of 1984 was enacted on October 9, 1984. This act aims to reform the disability determination process by providing for a more stringent standard of review for termination of disability benefits and periods of disability. The law requires substantial evidence to demonstrate medical improvement or new medical evidence and a new assessment of the individual's residual functional capacity. It also establishes a moratorium on mental impairment reviews until revised criteria are established, and requires notification of individuals being reviewed under section 221(i) of the Social Security Act. The act further allows individuals to elect payment of benefits during appeal, and provides for continuation of benefits during appeal in certain cases.
