Brief

This legislation, Part III of the Royal Canadian Mounted Police Superannuation Act, governs retirement benefits for officers in the Force. Key points include:

  1. Service Inclusion: The time served by an officer prior to their appointment as a non-commissioned officer or constable may be included in their term of service for pension purposes.

  2. Prior Service Credit: Time served in other police forces, civil services, and the permanent naval, army, or air forces can also be credited towards pension eligibility.

  3. Pension Calculation: A deduction of five percent per annum on pay is made from every officer's salary to fund pensions. This deduction cannot exceed thirty-five years of service.

  4. Gratuity for Infirmity: An officer who quits the Force due to infirmity or severe bodily injury may be granted a gratuity based on their length of service.

  5. Survivor Pension: A pension can be granted to the survivor and compassionate allowance to each child of an officer who died in service after ten years of employment, provided certain conditions are met.

  6. Gratuity for Reduction in Staff: An officer retired for efficiency or economy may receive a gratuity based on their length of service.

  7. Deductions for Financial Support: Amounts payable to an officer under this Part can be diverted to satisfy a financial support order, with the payment being deemed made to the officer.

  8. Election for Reduced Pension: An officer who could not have their spouse granted a pension due to certain conditions may elect to reduce their own pension amount to allow their spouse to receive a pension upon death.

  9. Payment of Reduced Pension: The reduced pension is paid to the spouse, provided they were married or cohabiting in a relationship of a conjugal nature for at least one year before the officer's death and the election has not been revoked.

  10. No Entitlement Conditions: A person who meets certain conditions, including being married at the time of the officer's death or cohabiting in a relationship of a conjugal nature, may be entitled to a reduced pension based on an election made by the officer.

  11. Pension Apportionment: If two survivors are granted pensions, the total amount is apportioned between them according to specific rules.

  12. No Pension or Allowance Conditions: A survivor pension or compassionate allowance cannot be granted under certain conditions, including if the survivor began cohabiting with the officer after the officer's retirement and the officer had attained the age of sixty years.
