Brief

'The Prevention of Terrorist Travel Act' was enacted on June 23, 2015, as part of the Statutes of Canada (S.C. 2015, c. 36). This act respects the protection of information in relation to certain decisions made under the Canadian Passport Order. The law allows for appeals and judicial review proceedings regarding passport cancellations or refusals due to terrorism or national security concerns. Individuals affected by such decisions can appeal within 30 days, with further time allowed at a judge's discretion. The judge must determine whether cancelling the passport is reasonable on the basis of available information and may quash the Minister's decision if deemed unreasonable. Specific rules apply during appeals, including confidentiality requirements for sensitive information. These rules also apply to judicial review proceedings regarding passport refusals or revocations on national security grounds.
