'The Administrative Monetary Penalties Regulations (Canadian Energy Regulator) were established by the National Energy Board under the National Energy Board Act. These regulations aim to ensure compliance with designated provisions, orders, and decisions made under the Act. The regulations designate specific violations that may be proceeded with in accordance with sections 116 to 135 of the Act. Violations are classified as Type A or Type B, and penalties for these infractions are determined based on a total gravity value established by considering various criteria, including whether the person has other previous violations, derived competitive benefit from the violation, provided assistance, reported the violation promptly, etc. The regulations also outline procedures for service of documents and come into force upon registration. Schedule 1 lists specific provisions of the Act that are designated as violations, while Schedule 2 sets out the penalties for these infractions.'
