Brief
The Public Service Superannuation Special Election Regulations are enacted pursuant to Subsection 32(10) of the Public Service Superannuation Act. These Regulations may be cited as the Public Service Superannuation Special Election Regulations.
These Regulations apply to a contributor under the Act who was one of a class of persons who received erroneous advice about counting their service under the Superannuation Act or the Act without contribution by them. The Regulations provide for an election process for these individuals to count their service for the purposes of the Act, which must be made within one year of receiving the erroneous advice.
A person described in section 3 may elect to count their service under the Act, and if they do so, they must pay the contribution that would have been required had they elected within the appropriate time prescribed by the Act. The election is deemed to have been made by the individual under the Act, and an adjustment will be made in respect of the contribution paid.
The Regulations also provide for adjustments to be made in respect of contributions made by individuals who would have a total period of service in excess of 35 years if the described service were added to their pensionable service. The President of the Treasury Board will determine the adjustment to be made, which may include refunds or reductions in the number of instalments.
