Coal Mining Industry (Long Service Leave) Legislation Amendment Act 2011

An Act to amend the law relating to long service leave in the black coal mining industry, and for related purposes.

This Act may be cited as the Coal Mining Industry (Long Service Leave) Legislation Amendment Act 2011.

Commencement

Each provision of this Act specified in column 1 of the table commence, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Part 1—Main amendments

  • Coal Mining Industry (Long Service Leave Funding) Act 1992
  • Part 2—Amendments relating to funding
  • Part 3—Other amendments

The Act introduces changes to the long service leave entitlement in the black coal mining industry, including:

  • Defining eligible employees and their employers
  • Determining the amount of long service leave credit an employee is entitled to
  • Regulating waiver agreements between employees and employers
  • Providing for payments on cessation of employment as an eligible employee

The Act also includes provisions for the approval and administration of waiver agreements, and penalties for non-compliance with certain requirements.
