Brief

The Coal Industry Repeal Act 2001 is an Australian Act that repeals the Coal Industry Act 1946 and provides related purposes. The Act commences on a day or days to be fixed by proclamation and amends or repeals certain Acts as specified in a Schedule to the Act.

The Joint Coal Board is dissolved, and it is intended that a law of New South Wales may make provision for the transfer of its assets, rights, and liabilities, as well as the transfer of its staff members. The Act also deals with workers' compensation schemes established by the Joint Coal Board, which are taken to have been established by the company nominated under clause 3 of Schedule 8 to the Coal Industry Act 2001 of New South Wales.

The Act provides for compensation in cases where the operation of the Act would result in the acquisition of property from a person without just terms. In such cases, the Commonwealth is liable to pay the person a reasonable amount of compensation in respect of the acquisition.

The Coal Industry Repeal Act 2001 repeals the entire Coal Industry Act 1946 and provides for related purposes. The Act comes into effect on a date to be fixed by proclamation.
