Brief
The Unsolicited Telecommunications Fees Regulations come into force on April 1, 2013, and they aim to regulate fees for individuals who subscribe to the National Do Not Call List. The regulations set out the amounts that must be paid by subscribers based on their subscription types.
The fees are as follows:
- For subscriptions from August 1, 2015, to March 31, 2016:
- Annual subscriptions: $18,793 (all area codes) or $1,124 (single area code)
- Monthly subscriptions: $11,438 (all area codes) or $585 (single area code)
- For subscriptions from April 1, 2016, to March 31, 2017:
- Annual subscriptions: $20,672 (all area codes) or $1,236 (single area code)
- Monthly subscriptions: $12,582 (all area codes) or $644 (single area code)
- For subscriptions on or after April 1, 2017:
- Annual subscriptions: $21,706 (all area codes) or $1,298 (single area code)
- Monthly subscriptions: $13,211 (all area codes) or $676 (single area code)
Subscribers must pay the fees to the Commission or to a delegate authorized by the Commission. The fees are subject to change based on the Commission's telemarketing regulatory costs for each fiscal year.
The regulations also provide that if the total of all amounts paid under subsection 3(1) in a given fiscal year is less than or equal to the Commission's telemarketing regulatory costs, the fees payable by a person for that year are equal to the amounts paid by them under subsection 3(1). If the total amount paid exceeds the Commission's telemarketing regulatory costs, the fee payable is calculated using a formula.
The regulations also require the Commission to publish its telemarketing regulatory costs annually in a public notice in the Canada Gazette and to publish the total of all amounts paid under subsection 3(1) in the last completed fiscal year.
