Brief

The Trademark Law Revision Act of 1988 amends the Trademark Act of 1946 to provide for a registration and protection of trademarks used in commerce. The act makes several changes, including revising the definition of a trademark, adding provisions for service marks, collective and certification marks, and disclaimer of unregistrable matter. It also provides for a statutory license for secondary transmissions of superstations and network stations for private home viewing by satellite carriers and amends the Communications Act of 1934 to address piracy of satellite cable programming. The act takes effect on January 1, 1989, except for certain provisions related to regulations issued by the Register of Copyrights, which take effect upon enactment.
