THE TRADE UNIONS ACT, 1926
This Act provides for the registration of Trade Unions and defines the law relating to registered Trade Unions. The Act extends to the whole of India and comes into force on a date to be appointed by the Central Government.
The Act defines various terms, including "executive", "office-bearer", "prescribed", "registered office", and "trade dispute". It also provides for the registration of Trade Unions, which shall be done by the Registrar. The rules of a Trade Union must provide for certain matters, including the name, objects, purposes, and membership.
The Act provides for various rights and liabilities of registered Trade Unions, including the payment of salaries and allowances to office-bearers, the prosecution or defense of legal proceedings, and the conduct of trade disputes. It also provides immunity from civil suit in certain cases and protects members from suits related to acts done in contemplation or furtherance of a trade dispute.
The Act prohibits agreements made by members for the purpose of committing an offense unless such agreement is intended to commit an actual offense. It also provides that the registration of any Trade Union under this Act shall be void if the same is made under any other law for the time being in force.
