The National Green Tribunal Act, 2010: An Overview
This Act establishes a National Green Tribunal to exercise jurisdiction, powers, and authority over environmental protection and conservation issues. The Tribunal will settle disputes related to environmental protection, provide relief and compensation for damages, and have appellate jurisdiction.
The Act provides for the establishment of the Tribunal with a Chairperson, Judicial Members, and Expert Members, who are appointed by the Central Government based on specific qualifications. The Tribunal has jurisdiction over all civil cases involving substantial questions relating to the environment, enforcement of legal rights, and damage to property or environment.
The Act also provides for the power to impose penalties for failure to comply with orders of the Tribunal, as well as the liability to pay relief or compensation in certain cases. The Tribunal may divide compensation into separate heads specified in Schedule II to provide relief to claimants and restitution of damaged property or environment.
Other provisions of the Act include the bar of jurisdiction, cognizance of offences, and the protection of action taken in good faith. The Act also empowers the Central Government to make rules and amendments, as well as repeal and save previous laws.
