Brief

The Commissions for Protection of Child Rights Act, 2005, is an Act that provides for the constitution of a National Commission and State Commissions for Protection of Child Rights and Children's Courts for providing speedy trial of offences against children or of violation of child rights.


The Act extends to the whole of India and shall come into force on such date as the Central Government may appoint. It defines various terms used in the Act, including "Chairperson", "child rights", "Commission", "Member", and "notification".


The National Commission for Protection of Child Rights is constituted by the Central Government under section 3, consisting of a Chairperson and six Members. The Chairperson and Members hold office for a term of three years from the date on which they assume office.


The Act provides various functions and powers to the Commission, including examining and reviewing safeguards provided by or under any law for the protection of child rights, presenting annual reports to the Central Government, inquiring into violations of child rights, studying treaties and other international instruments, and undertaking research in the field of child rights.


The State Commissions are also constituted by the State Governments, consisting of a Chairperson and six Members. They have similar functions and powers as the National Commission.


The Act also provides for the appointment of Special Public Prosecutors for Children's Courts, grants to the Commission and State Commissions, accounts and audit of the commissions, and protection of action taken in good faith.


The provisions of certain sections of the Act are applicable to State Commissions with modifications. The Act also makes provision for children's courts, which provide speedy trial of offences against children or of violation of child rights.


The Central Government shall pay grants to the Commission by way of appropriation made by Parliament by law in this behalf, and the Commission may spend such sums of money as it thinks fit for performing its functions under the Act.


The Act makes provision for the maintenance of proper accounts and other relevant records, annual statement of accounts, audit by Comptroller and Auditor-General, and other provisions related to finance, accounting, and auditing.
