THE CARRIAGE BY AIR ACT, 1972
This Act gives effect to the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw on October 12, 1929, and as amended by the Hague Protocol on September 28, 1955, and the Montreal Convention signed on May 28, 1999.
The Act applies to non-international carriage by air and provides for matters connected therewith. The rules contained in the First Schedule have the force of law in India in relation to any carriage by air to which those rules apply, irrespective of the nationality of the aircraft performing the carriage.
The Act defines various terms including "amended Convention", "Convention", "Montreal Convention", and "Annexure". It also provides for liability in case of death, conversion of francs, conversion of Special Drawing Rights, provisions regarding suits against High Contracting Parties who undertake carriage by air, application of the Act to carriage by air which is not international, and power to make rules.
The First Schedule contains rules relating to international carriage of persons, luggage or goods performed by aircraft for reward. The Second Schedule contains rules relating to amended Convention. The Third Schedule contains rules relating to Montreal Convention.
The Act also provides for liability in case of death, conversion of francs, conversion of Special Drawing Rights, provisions regarding suits against High Contracting Parties who undertake carriage by air, application of the Act to carriage by air which is not international, and power to make rules.
