THE ALL-INDIA INSTITUTE OF MEDICAL SCIENCES ACT, 1956
This Act provides for the establishment of All-India Institutes of Medical Sciences (AIIMS) and their functions.
Establishment and Incorporation of the Institute
The AIIMS are established by notification in the Official Gazette, and they shall be a body corporate with perpetual succession and a common seal. The Institute shall consist of various members, including the Vice-Chancellor of Delhi University, Director General of Health Services, and representatives from the Central Government.
Declaration of Institutes as Institution of National Importance
The existing Institute is declared an institution of national importance, and every corresponding Institute and other Institutes established on and after the commencement of the All-India Institute of Medical Sciences (Amendment) Act, 2012, are also declared institutions of national importance.
Term of Office of Members
The term of office of members shall be five years from the date of their nomination or election. Ex officio members shall continue in office until they cease to hold their respective offices.
President of the Institute
There shall be a President for every Institute, nominated by the Central Government from among its members.
Allowances of President and Members
The President and members shall receive such allowances as may be prescribed by rules.
Meetings of the Institute
Every Institute shall hold its first meeting at a time and place appointed by the Central Government, and thereafter observe such rules of procedure in regard to the transaction of business as may be prescribed by regulation.
Governing Body and other Committees of the Institute
There shall be a separate Governing Body for every Institute, constituted by such Institute from among its members. The President of the Institute shall be the Chairman of the Governing Body and exercise such powers and discharge such functions as may be prescribed by regulations.
Staff of the Institute
There shall be a chief executive officer of every Institute, designated as the Director of such Institute, who shall subject to such rules as may be made by the Central Government, be appointed by the Institute. The Director shall hold office for a term of five years from the date on which he enters upon his office or until he attains the age of sixty-five years.
Location of the Institute
The existing Institute shall be located at New Delhi, and all corresponding Institutes shall be located at such places as the Central Government may specify. All other Institutes shall be located at such places as the Central Government may notify by notification in the Official Gazette.
Objects of the Institute
The objects of every Institute are to develop patterns of teaching in under-graduate and post-graduate medical education, bring together educational facilities of the highest order for the training of personnel in all important branches of health activity, and attain self-sufficiency in post-graduate medical education.
Functions of the Institute
Every Institute may provide for under-graduate and post-graduate teaching in modern medicine and other allied sciences, provide facilities for research in various branches of such sciences, conduct experiments in new methods of medical education, prescribe courses and curricula for both under-graduate and post-graduate studies, and hold examinations and grant degrees, diplomas, and other academic distinctions and titles.
Payment to the Institute
The Central Government may pay to every Institute in each financial year such sums of money as may be considered necessary by that Government for the exercise of its powers and discharge of its functions under this Act.
Fund of the Institute
Every Institute shall maintain a fund to which shall be credited all moneys provided by the Central Government, fees and other charges received by the Institute, grants, gifts, donations, benefactions, bequests, or transfers, and other moneys received in any manner or from any source.
Budget of the Institute
Every Institute shall prepare a budget in respect of the financial year next ensuing, showing estimated receipts and expenditure, and forward to the Central Government such number of copies thereof as may be prescribed by rules.
Accounts and Audit
Every Institute shall maintain proper accounts and other relevant records and prepare an annual statement of accounts, including the balance-sheet, in such form as the Central Government may prescribe in consultation with the Comptroller and Auditor-General of India.
Annual Report
Every Institute shall prepare for every year a report of its activities during that year and submit the report to the Central Government in such form and on or before such date as may be prescribed by rules, and a copy of this report shall be laid before both Houses of Parliament within one month of its receipt.
Pension and Provident Funds
Every Institute shall constitute for the benefit of its officers, teachers, and other employees in such manner and subject to such conditions as may be prescribed by regulations, such pension and provident funds as it may deem fit.
Recognition of Medical, Dental, and Nursing Qualifications
The medical, dental, or nursing degrees or diplomas granted by every Institute under this Act shall be recognized for the purpose of the Indian Medical Council Act, 1956, Dentists Act, 1948, and Indian Nursing Council Act, 1947.
