Brief
The Regulations Amending the Trademarks Regulations were created by His Excellency the Administrator of the Government of Canada in Council. They were made pursuant to section 65 of the Trademarks Act on the recommendation of the Minister of Industry. The regulations amended the Trademarks Regulations, which had been enacted under the Trademarks Act.
There are eight amendments to the former Regulations, which include revoking the appointment of trademark agents who are not resident in Canada and re-designating those who were previously appointed as associate trademark agents. Additionally, firms that were previously registered as trademark agents or associate trademark agents are now deemed to be registered under the new regulations.
The new regulations also establish a transition period during which they come into force on different dates depending on when they are registered. This change aims to ensure consistency and continuity in the administration of trademarks in Canada. Overall, the Regulations Amending the Trademarks Regulations aim to update and refine the existing trademark registration system in accordance with evolving legislative requirements.
