The Real Property Grants Regulations, cited as C.R.C., c. 343, outline the guidelines for granting provinces with federal property located within their territories. The regulations aim to ensure that provinces are compensated fairly for the use and maintenance of these properties.


According to the document, "federal property" refers to real estate owned by Her Majesty in right of Canada, excluding certain types of properties such as those forming part of an undertaking in conservation or reforestation, parks, historical sites, and military establishments. The regulations also define "municipality" as any public board or authority that exercises a function of local government.


The document sets out the rules for granting provinces with federal property, including the conditions under which a grant may be made. A grant can be made in respect of federal property situated in a province if the property is not exceeding a certain amount obtained by applying the effective rate of the real estate tax levied in the province to the accepted value of the federal property.


The regulations also provide for deductions from the grant amount, including an amount representing the value of services customarily furnished by the province or Her Majesty. The Minister has discretion to determine the amount of any grant and may consider special circumstances arising out of heavy concentrations of federal property in a particular region.
