Brief

This section outlines provisions for extending compensation plans and changing terms and conditions under certain circumstances.

Extension of Compensation Plans (Section 6)

  • If a compensation plan has expired before February 26, 1991, or no new compensation plan was established by that date, the compensation plan shall be extended for 12 months beginning on the day immediately following its expiration date.
  • This extension applies if no new compensation plan is established in accordance with subsection 5(2) by that date.

Terms and Conditions (Section 7)

  • Notwithstanding other Acts of Parliament except the Canadian Human Rights Act, the terms and conditions of:
    • Compensation plans extended under sections 5 or 6
    • Collective agreements or arbitral awards including compensation plans shall continue in force without change for the period for which the compensation plan is so extended.

Authorized Changes (Section 7)

  • The Treasury Board may authorize any change to terms and conditions of:
    • Compensation plans that would have expired before February 26, 1991, but for section 6
    • Collective agreements or arbitral awards including such compensation plans

Civilian Reduction Program (Section 7.1)

  • Notwithstanding this Act or other Acts of Parliament except the Canadian Human Rights Act, the Treasury Board may:
    • Fix terms and conditions of the Civilian Reduction Program arising from the February 22, 1994 budget
    • Offer or give payments under the program to indeterminate employees of the Department of National Defence, Emergency Preparedness Canada, and the Communications Security Establishment who are subject to that Program.

Early Departure Incentive (Section 7.2)

  • Notwithstanding this Act or other Acts of Parliament except the Canadian Human Rights Act, the Governor in Council may:
    • Fix terms and conditions of a program arising from the February 27, 1995 budget
    • Designate departments or portions of the public service to which that program is to apply
  • The Treasury Board may offer or give payments under the program to surplus employees within the meaning of the Work Force Adjustment Directive or otherwise subject to the program.
