The Parliament of Australia enacts:
1 Short title
This Act is the Product Emission s Standards (Customs) Charges
Act 201 7.

2 Comm encement
(1) Each provision of this Act specified in column 1 of the table
commences, or is taken to have commenced, in accordance with
column 2 of the table. Any other statement in column 2 has effect
according to its terms.

3 Act binds the Crown
This Act binds the Crown in each of its capacities.
4 Definitions
In this Act:
amount includes a nil amount.
emissions -controlled product has the same meaning as in the
Product Emission s Standards Act 201 7.
5 Imposition of charge
Charge is imposed on the importation of emissions -controlled
product s.

6 Amount of charge
The amount of the charge imposed on the importation of an
emissions -controlled product is the amount:
(a) prescribed by the regulations; or
(b) worked out in accordance with a method prescribed by the
regulations.
7 Liability for charge
Charge imposed on the importation of an emissions -controlled
product is payable by the person who imports the product.
8 Regulations
The Governor -General may make regulations prescribing matters:
(a) required or permitted by this Act to be prescribed; or
(b) necessary or convenient to be prescribed f or carrying out or
giving effect to this Act.
