'The Federal Water Pollution Control Act was amended by Public Law 97-440 on January 8, 1983, to allow modifications of certain effluent limitations relating to biochemical oxygen demand and pH. The amendment permits the Administrator, with State concurrence, to issue a permit modifying these requirements for industrial dischargers in deep waters of the territorial seas if specific conditions are met, including demonstration of unreasonable costs and establishment of a monitoring system.'
