The Energy Efficiency Regulations, 2016, were made under the Energy Efficiency Act to implement energy efficiency standards for various products. The regulations set out definitions and requirements for the labelling, certification, and provision of information related to energy-using products.
The regulations define key terms such as "adhesive tag", "flap tag", "hang tag", "verification mark", and "unique motor identifier". They also specify the application of standards and procedures from other jurisdictions, while providing exceptions for certain test procedures.
The Regulations require that every energy-using product shipped from one province to another or imported into Canada must be labelled with a verification mark issued by a certification body or a province. The verification mark must be readily visible on the surface of the product. Exceptions apply for certain products such as CFLs, external power supplies, and general service lamps.
Dealers who import energy-using products into Canada are required to provide information about the product's model number, manufacturer, and other relevant details. This information must be provided electronically or by fax, hand delivery, courier, or mail before the product is released under the Customs Act.
The Regulations also exempt dealers from certain provisions of the Act if they modify an energy-using product to comply with the applicable energy efficiency standard or ship it for export. Additionally, dealers are exempt from providing information about motors with the same unique motor identifier.
