The Eligible Financial Contract Regulations (Companies' Creditors Arrangement Act) are a set of rules made under the Companies' Creditors Arrangement Act. The regulations come into force on November 15, 2007.
These Regulations apply to financial agreements that meet certain criteria, including being traded on regulated markets or subject to recurrent dealings in derivatives markets. The regulations also cover agreements to borrow or lend securities or commodities, as well as repurchase and buy-sellback agreements.
The definitions provided in these Regulations include the term "derivatives agreement", which encompasses a range of financial agreements, including contracts for differences, swaps, futures agreements, options, and spot or forward agreements.
Financial intermediaries are also defined, including clearing agencies and persons that maintain securities accounts or futures accounts for others.
These Regulations are intended to facilitate the regulation of financial markets and ensure that eligible financial contracts are properly managed.
