The Electronic Alternatives Regulations for the Purposes of Subsection 254(1) of the Canada Labour Code were made by the Minister of Labour under the Personal Information Protection and Electronic Documents Act. The regulations aim to provide electronic alternatives to traditional paper-based pay statements, as required by subsection 254(1) of the Canada Labour Code.


The regulations define key terms such as "employer" and "pay statement," which are used throughout the document. According to the regulations, a pay statement must be provided to an employee through an electronic source, such as a website, that is accessible to the employee and whose location is made known to them.


To satisfy the requirement of being in writing, an electronic document must meet two conditions: (a) it must be provided to the employee through an electronic source, and (b) it must be readable and printable on a computer and printer to which the employer provides private access. The regulations also state that a pay statement is considered furnished to the employee when the electronic document is provided in accordance with these conditions.


The regulations come into force on the day they are registered, providing a timeline for employers to implement electronic alternatives to traditional paper-based pay statements.
