The Copyright Remedy Clarification Act was passed on November 15, 1990, Public Law 101-553, amending chapters 5 and 9 of title 17, United States Code. The act clarifies that states, instrumentalities of states, and state officials can be sued in federal court for copyright infringement and exclusive rights in mask works, providing the same remedies as suits against private entities. This change took effect with respect to violations occurring on or after November 15, 1990.
