Brief
The Competition Tribunal Rules, made by the Competition Tribunal pursuant to subsection 16(1) of the Competition Tribunal Act, outline the procedures and rules for proceedings before the Tribunal. The Rules apply to all parties involved in a proceeding, including applicants, respondents, intervenors, and witnesses.
The Rules provide for dispensensing with compliance with certain rules in exceptional circumstances, as well as varying or supplementing the application of these Rules. Time limits under the Rules are calculated under sections 26 to 30 of the Interpretation Act, unless otherwise provided.
The Rules also outline procedures for filing documents, including electronic filing, and provide for proof of service. Parties must file their documents by electronic transmission, with some exceptions allowed. Documents filed electronically must be time-stamped and may be transmitted via facsimile or electronic mail.
Additionally, the Rules address issues related to witness testimony, including sworn statements and solemn affirmations. These statements may be filed electronically but must be maintained in paper form for a period of one year after all periods for appeals expire.
The Tribunal reserves the right to draw attention to any irregularity or defect relating to an electronic version of a document and permit the party to remedy it on any conditions that the Tribunal considers fair.
