Brief
The Class Action Fairness Act of 2005 was enacted on February 18, 2005, to amend procedures for considering interstate class actions and ensure fairer outcomes for class members and defendants. The Act added a new chapter to Title 28 of the United States Code, establishing a "Consumer Class Action Bill of Rights" and improved procedures for interstate class actions. It also amended Section 1332 of Title 28 to provide for Federal district court jurisdiction in interstate class actions, and allowed for the removal of such cases to Federal district court. The Act required notice to be given to Federal and State officials upon filing a proposed settlement, and imposed certain requirements on attorneys' fees in coupon settlements.
