The Aeronautics Act establishes the Canadian Air Transport Security Authority as an agent of Her Majesty to perform certain duties and functions related to aviation security. The Authority is governed by a board, which must include between 5 and 11 directors appointed by the Governor in Council. Directors serve for a term not exceeding five years and may be renewed once.
The Chairperson presides at meetings of the board and exercises powers and performs duties assigned by the Authority's by-laws. The chief executive officer is responsible for the day-to-day management of the Authority, but must carry out their duties on a full-time basis.
The Authority may employ officers, employees or agents as necessary for its activities and affairs and fix terms and conditions of their engagement. However, the Chairperson, chief executive officer, directors, officers, and employees are deemed to be employees for the purposes of the Government Employees Compensation Act and to be employed in the public service of Canada.
The Authority may enter into contracts, agreements or arrangements with Her Majesty as if it were not an agent of Her Majesty. It may also enter into agreements with the Royal Canadian Mounted Police for the provision of services, including on aircraft, and make payments in respect of those services.
The Authority may enter into agreements with the operator of an aerodrome designated by regulation to contribute to the costs of policing incurred by that operator. Every operator of such an aerodrome must provide space and services at the aerodrome to the Authority, free of charge.
The Authority has a mandate to deliver screening referred to in subsection 6(1) with any person who requests it. This includes any screening delivered directly or through a screening contractor under an agreement entered into by the Authority with such a person.
