The Book Importation Regulations, which came into force on September 1, 1999, outline the rules for importing books into Canada. The regulations define various terms, including "book," "exclusive distributor," and "Canadian edition." They also establish criteria for the distribution of imported books, including deadlines for shipping and pricing guidelines.
The regulations require exclusive distributors to provide notice to retailers before they place an order, and specify that the distributor must ship books within three days for English-language books and five days for French-language books. If a retailer requests confirmation on whether an order can be filled, the distributor must respond within two to five days, depending on the method of communication.
The regulations also permit the importation of Canadian editions, remaindered books, damaged books, and textbooks under certain conditions. Specifically, Canadian editions must be identified as such before an order is placed, while remaindered books must be marked as such or imported solely for re-export. Textbooks may be imported if they are used and intended for sale or distribution in Canada.
In addition, the regulations allow special orders to be filled through a person other than the exclusive distributor if the distributor is unable to fill the order within the specified time frame. Leased books may also be imported through a third party.
