The Arctic Waters Pollution Prevention Regulations aim to prevent pollution in the arctic waters by regulating the deposit and disposal of waste. The regulations apply to both domestic and industrial waste, with specific conditions for their disposal on land or in water. Any person depositing or permitting the deposit of waste must report any accidents or occurrences that may lead to pollution.
The regulations also establish limits of liability for operators engaged in various activities such as sewage operations, pipeline operations, and storage of substances. In addition, ship owners are required to file evidence of financial responsibility with the Minister, demonstrating their ability to cover potential costs associated with waste deposits in arctic waters.
These regulations further specify that the owner of any cargo carried on a ship navigating in arctic waters is jointly responsible with the ship owner for filing relevant declarations and ensuring the truth of statements contained therein. The maximum amount of liability for both the ship owner and cargo owners is determined based on the ship's tonnage, with a cap of 210 million gold francs.
The regulations also consider situations where the owner or underwriter of a ship has taken action to repair or mitigate damage resulting from waste deposits, which may reduce their liability. Overall, these regulations aim to prevent pollution in arctic waters and establish clear responsibilities for operators and ship owners involved in activities that pose potential risks to the environment.
