Apprentice Loans Act

The Act provides for the making of regulations under various sections, including section 11, which deals with apprentice loans. The Minister may prescribe regulations regarding the eligibility criteria for apprenticeships, apprentice loans, and repayment of loans. The regulations can also provide for the form and manner in which information is to be provided.

In addition, the Act provides for the recovery of money owing under this Act, including through deduction from, set-off against, or compensation against any sum of money that may be due or payable by Her Majesty in right of Canada to the person or their estate or succession.

The Minister can also take remedial action if a person was denied an apprentice loan as a result of an error made in the administration of this Act or the regulations. The limitation or prescription period for recovering money owing under this Act is six years, but it can be suspended during any period in which it is prohibited to commence or continue an action or other proceedings against the borrower.

The Minister may also require any person who has received an apprentice loan to provide information or documents to verify compliance or prevent non-compliance with this Act. A document provided in accordance with this requirement is evidence of its nature and content, and a certified copy of it has the same probative force as the original document.
