Antarctic Environmental Protection Act

The Act provides regulations for Canadian expeditions and vessels operating in Antarctica. The Act defines various terms, including "native bird," "native invertebrate," "native mammal," and "native plant." It also prohibits introducing non-native species into Antarctica.

Additionally, the Act regulates waste disposal and requires permits for certain activities, such as disposing of waste or using specially protected areas. It also sets out conditions for permits, including conducting environmental impact assessments and preparing waste management and emergency plans.

The Act provides that permits can be refused or suspended if the Minister is of the opinion that the public interest warrants it. The Minister must consider a preliminary environmental evaluation before issuing a permit, and may require an initial or comprehensive evaluation depending on the expected environmental impact.

Permits are required for Canadian expeditions and vessels operating in Antarctica, and the holder of a permit is deemed to have contravened a condition if they are aware that another person or vessel bound by their permit has done so. The Minister can restrict permits if they believe the activities will have a significant adverse environmental impact.

The Act also requires security from applicants for permits, which can be applied by the Minister to reimburse Her Majesty in right of Canada for costs incurred in preventing, mitigating, or remedying any harm caused by an activity.
