Brief
The Airports (On-Airport Activities Administration) Validation Act 2010 is an Act that provides certainty about the validity of certain airport matters and for related purposes. The Act was assented to on June 29, 2010.
This Act may be cited as the Airports (On-Airport Activities Administration) Validation Act 2010. It commences on the day it receives the Royal Assent.
Section 2 deals with the validation of infringement notices issued before the commencement of this section. It states that a notice is valid and effective if the person who issued it was validly appointed as an authorized person for the purpose of the provision concerned, and the thing did happen.
Section 4 validates other things done by a person before the commencement of this section, including the purported performance of any function or exercise of any power. It states that such actions are valid and effective if the person who did them was validly appointed as an authorized person for the purpose of the provision concerned.
Sections 3 and 4 apply in relation to places that were Commonwealth places during a period before the commencement of this section, in the same way as they apply to other places.
Section 6 provides for compensation for the acquisition of property. If the operation of this Act would result in an acquisition of property from a person otherwise than on just terms, the Commonwealth is liable to pay a reasonable amount of compensation to the person.
The Act is designed to provide certainty about the validity of certain airport matters and to address concerns about the validity of infringement notices and other actions taken by authorized persons.
