The Administrative Monetary Penalties (Canada Labour Code) Regulations set out the framework for administrative monetary penalties under the Canada Labour Code. The regulations designate specific violations that may be proceeded with in accordance with Part IV of the Act, and classify them into Type A, B, C, D, or E violations based on their severity. The baseline penalty amount for each violation is determined by reference to Schedule 3, which sets out various amounts corresponding to different categories of persons or departments believed to have committed the violation. In addition to the baseline penalty amount, a history of non-compliance may also be taken into account to determine the total penalty amount. A person or department may pay an early payment of half the penalty for Type A, B, or C violations within 20 days after receiving a notice of violation. The regulations also prescribe the manner in which notices of violation are to be served and provide for requests for review to be made in writing with a statement of grounds for review.
