The Conseil d'État rejected the appeals of two regional counselors, Messrs. Wallerand de Saint-Just and Nicolas Bay, against their compulsory resignations due to penalties of ineligibility imposed by a penal court. The Court did not refer to the Constitutional Council a priority constitutional question contesting the conformity of electoral code provisions to the Constitution. The Conseil d'État considered that the provisions applicable to regional counselors and their situation were analogous to those applicable to municipal counselors, who were recently validated by the Constitutional Council in an identical interpretation. The Court rejected the appeals and confirmed the resignation of both counselors from their positions.
