Brief

The Representation of the People (Amendment and Validation) Act, 2013 aims to amend the Representation of the People Act, 1951. The proposed amendments include adding a condition to the definition of "disqualified" in section 7, stating that a member of Parliament or State Legislature shall be disqualified only if they are so disqualified under Chapter III of Part II and on no other ground. Additionally, a proviso is added to section 62 to clarify that a person whose name has been entered in the electoral roll shall not cease to be an elector due to prohibition from voting. The Act also validates previous provisions, ensuring their effectivity for all purposes despite any judgments or orders to the contrary. This amendment aims to address concerns arising from a Supreme Court order declaring individuals without the right to vote as non-elector and non-qualified to contest elections.
