Brief

The Constitution (One Hundred Seventeenth Amendment) Act, 2012 aims to amend Article 16 of the Indian Constitution. The amendment seeks to provide reservation in promotion for the Scheduled Castes and Scheduled Tribes, despite the Supreme Court's judgment in M. Nagaraj Vs. UOI & Ors., which held that reservations in promotion require compelling reasons such as backwardness, inadequacy of representation, and overall administrative efficiency. The proposed amendment intends to bring certainty and clarity in the matter of reservation for these communities and provide retrospective effect from June 17, 1995, when the original clause (4A) was introduced.
