В ходе работы по обращению установлено,
что освидетельствование осужденной В. для определения группы инвалидности
проведено в марте 2024 года, в этом же месяце индивидуальная программа
реабилитации и абилитации инвалида поступила в исправительное учреждение.
Как гражданка Российской Федерации,
В. имеет равные возможности на предоставления
мер социальной поддержки инвалидов. Приказом
Министерства юстиции РФ от 22 сентября 2015 г. № 222 «Об утверждении порядка
обеспечения условий для проведения реабилитационных мероприятий, пользования
техническими средствами реабилитации и услугами, предусмотренными
индивидуальной программой реабилитации или абилитации инвалида в отношении
осужденных, являющихся инвалидами и находящихся в исправительных учреждениях»
определено, что условия для
проведения реабилитационных мероприятий, пользования техническими средствами
реабилитации и услугами, предусмотренными индивидуальной программой
реабилитации или абилитации инвалида в отношении осужденных, являющихся

администрацией исправительного учреждения.
Столь длительное необеспечение инвалида техническими средствами
реабилитации, необходимыми для компенсации стойких ограничений
жизнедеятельности, безусловно, нарушает права осужденной на охрану здоровья и
социальную защиту.
Уполномоченным в адрес начальника ГУФСИН России по Иркутской области направлены рекомендации о принятии необходимых мер по восстановлению прав осужденной В., а
также и недопущению в дальнейшем нарушений
федерального законодательства в отношении осужденных инвалидов, нуждающихся в
технических средствах реабилитации.
Фактическое обеспечение заявителя
техническими средствами реабилитации остается на контроле Уполномоченного.
