Purpose

The National Institute of Industrial Property (INPI) has informed that, starting from January 2025, the Geographical Indications Manual will be updated continuously. The manual will be identified by the date of the last update, indicated on the home page. This change aims to provide more agility in implementing procedure and guidance improvements for users.

The INPI had previously implemented continuous updates in the Industrial Designs Manual in July 2024 and the Trademarks Manual in August 2024. The January 16, 2025, update of the Geographical Indications Manual included simplification of documentary proof requirements in registration and alteration of IG registration requests.

Effects on Industry

The INPI’s change to a continuous updating system for the Geographical Indications Manual is expected to positively impact industries by providing more timely and accurate information. This will enable companies and stakeholders to make informed decisions based on up-to-date guidelines and procedures. Additionally, the simplification of documentary proof requirements in registration requests may reduce administrative burdens and facilitate the registration process.

The long-term effects of this update are likely to include improved efficiency in the registration process, increased transparency, and better alignment with international standards. These changes may also contribute to a more competitive business environment by providing clearer guidance on geographical indications.

Relevant Stakeholders

Stakeholders affected by this change include businesses and companies involved in the production and trade of goods protected by geographical indications. This includes wine producers, agricultural companies, and food manufacturers, among others. Consumers and consumers’ organizations may also be indirectly impacted by changes in product labeling and certification requirements.

Additionally, trademark attorneys, lawyers, and other professionals specializing in intellectual property law will need to be aware of the updated guidelines and procedures for accurate advice and representation of clients.

Next Steps

To comply with or respond to this update, stakeholders should:

  1. Familiarize themselves with the new continuous updating system and its implications.
  2. Review and adapt their internal procedures and policies accordingly.
  3. Ensure they are informed about any changes in registration requirements, documentation, and certification processes.
  4. Consider consulting experts or industry associations for guidance on implementing these updates.

Any Other Relevant Information

The update to the Geographical Indications Manual is part of a broader effort by INPI to modernize its procedures and guidelines. This includes the implementation of new technologies and digital tools to improve transparency, efficiency, and user experience.

In addition to the January 2025 update, stakeholders should also be aware of future actions and developments related to geographical indications, such as changes in international agreements or updated guidelines from industry associations. Regular monitoring of INPI’s announcements and updates will help stakeholders stay informed about these developments.
