Brief
On "05/11/2024", the "Competition and Markets Authority" issued an update regarding "Draft new guidance for the markets regime in the Enterprise Act 2002". The CMA has reviewed whether the current guidance should be updated to reflect developments in legislation and CMA practice over time, and proposes that certain existing markets guidance should be consolidated and simplified.
The CMA is consulting on a draft package of new guidance, consisting of three modules: Markets Procedural Guidance, Markets Substantive Assessment Guidance, and Markets Remedies Guidance. The update also reflects changes to the Digital Markets, Competition and Consumers Act 2024 (DMCC A24) and introduces new powers for the CMA, such as accepting partial or full undertakings under Part 4 of EA02.
