O Plenário do Coaf concluiu o exame de oito Processos Administrativos Sancionadores (PAS) na última sessão de julgamento, realizada por videoconferência no dia 9 de agosto de 2023, quando foram aplicadas multas que somaram R$ 483 mil.

Os processos julgados haviam sido instaurados em face de empresas diretamente sujeitas à supervisão do Coaf em matéria de prevenção à lavagem de dinheiro e ao financiamento do terrorismo e da proliferação de armas de destruição em massa (PLD/FTP). Desses PAS, dois referiam-se a empresas do setor de bens de luxo ou de alto valor, um envolvia empresa do comércio de joias, pedras e metais preciosos e cinco de fomento comercial (factoring).

As infrações punidas relacionavam-se ao descumprimento de deveres de identificação e manutenção de cadastro atualizado de clientes; deficiência na implementação de política de prevenção à lavagem de dinheiro e ao financiamento do terrorismo e da proliferação de armas de destruição em massa (PLD/FTP); descumprimento do dever de manter cadastro atualizado no Coaf; e envio de não comunicação ao Coaf de operações em espécie que atingiram o limite normativo; e não comunicação ao Coaf da ausência de operações passíveis de comunicar.

Com essa sessão de julgamento do seu Plenário, em que as multas aplicadas somaram R$ 483 mil, o Coaf alcançou, em valores históricos (sem atualização), o montante de R$ 183,6 milhões em multas aplicadas, no universo dos 631 PAS que a unidade de inteligência financeira nacional já julgou no exercício de sua competência residual para supervisionar o cumprimento dos mencionados deveres de PLD/FTP por pessoas obrigadas diretamente sujeitas aos normativos do próprio Coaf, entre aquelas referidas no art. 9º da denominada Lei de Lavagem de Dinheiro (LLD) – a Lei nº 9.613, de 3 de março de 1998 – para as quais não exista órgão próprio que as possa regular ou fiscalizar.

This session of the Plenary marks a significant milestone for Coaf, as it brings the total amount of fines imposed since the unit’s inception to R$ 183.6 million, based on the 631 PAS already examined by the unit under its residual competence to supervise the fulfillment of the aforementioned duties by individuals directly subject to Coaf’s regulations and those mentioned in article 9 of the Anti-Money Laundering Act (LLD) – Law No. 9,613 of March 3, 1998 – for which there is no specific agency responsible for their regulation or supervision.
