A respeito da aplicação da 2ª edição do Manual de Desenhos Industriais, instituído pela Portaria INPI/PR nº 36/2023, que entrou em vigor em 02 de outubro de 2023, o INPI informa que:

a) O exame inicial do pedido de registro de Desenho Industrial é realizado conforme norma vigente no momento do exame, independente da data de depósito do pedido;

b) O exame do Cumprimento de Exigência é realizado conforme norma vigente no momento do exame. Tal aplicação independe da data de publicação da Exigência ou da data da petição do Cumprimento de Exigência;

c) Durante o exame do Cumprimento de Exigência a que se refere a alínea b), serão aproveitados desenhos, fotografias e outros dados, seja do pedido inicial ou de Cumprimento de Exigência anteriormente formulada, que estejam em conformidade com o disposto na norma vigente no momento do exame. Tal aproveitamento não impede a publicação de nova Exigência para adequação de aspectos que não estejam de acordo com a norma vigente;

d) O pedido de registro de Desenho Industrial que teve recurso administrativo provido será reconduzido ao exame técnico, que por sua vez será realizado conforme norma vigente, independente da data do depósito; e

e) Uma vez reconduzido ao exame técnico, o pedido de registro de Desenho Industrial que teve recurso administrativo provido poderá estar sujeito a novas exigências e, no caso de não cumprimento tempestivo no prazo de 60 dias, será arquivado em definitivo com base no parágrafo 3º do Art. 106 da LPI.

Failure to comply within 60 days may result in the application being definitively archived, according to Article 106, paragraph 3, of the Brazilian Industrial Property Law (LPI).
