Brief

On 03/04/2025, the European Court of Justice (ECJ) issued an update regarding Alchaster II. The ECJ held that a change to the licence regime in the United Kingdom, which hardens the conditions for release on licence, does not amount to the imposition of a heavier penalty than the one initially provided for. This decision paves the way for the surrender of a person suspected of terrorism-related offences in Northern Ireland to the UK under the Trade and Cooperation Agreement (TCA).
