Summary
On October 2nd, 2023, the 2nd edition of the Industrial Design Manual was officially launched by the Brazilian Industrial Property Office (INPI). This new edition brings significant changes to the guidelines for examining Industrial Design applications. Some key updates include:
Protection of bidimensional or tridimensional ornamental configurations applied to electronic devices
Protection of tridimensional configurations composed of non-mechanically connected parts
Protection of Industrial Designs including logos or trademarks
Protection of Industrial Designs including text elements in any language
New representation options for registered objects
Publicity of priority maintenance conditions and examination of correspondence between Brasil and international applications
Introduction of electronic documentation submission and examination using WIPO-DAS
Publication of parameters for novelty and originality examinations
Incorporation of design designation guidelines from the Hague Agreement
Additionally, the INPI has also published new rules for examination and filing fees, introducing a new service for non-disclosure of inventor names, and reorganizing some services and naming conventions.
