"On 09/01/2025", the "European Court of Justice (ECJ)" issued an update regarding "Competition law and distribution deals: The exclusive distributor must be protected against active sales in its territory by all the supplier’s other buyers". According to the Advocate General's Opinion, Article 4(b)(i) of Regulation No 330/2010 contains a 'parallel imposition requirement', requiring suppliers to protect their exclusive distributors against active sales by other buyers. This condition is fulfilled only when other buyers expressly or tacitly accept an active sales ban in the exclusive territory.
