Brief
The National Institute of Design Act, 2014 is being amended through a Bill to make various changes. Clause 1 amends section 5 to provide that any reference to the Society mentioned in the Schedule shall be deemed as a reference to the corresponding Institute mentioned therein.
Clause 2 seeks to amend section 6 so as to substitute the words "the Institute" with the words "each Institute". Clause 3 amends section 7 by substituting the words "The Institute" with the words "Every Institute".
Clauses 4 to 32 make various amendments to sections 8-39 of the Act, replacing instances of "the Institute" with "each Institute", "every Institute", or "any Institute". These changes aim to bring consistency in language and reference to the National Institutes of Design.
Clause 33 inserts two explanations into section 40, providing that for the purposes of this section, the commencement date shall be deemed as September 16, 2014, for the National Institute of Design, Ahmedabad, and as the date when the provisions of the National Institute of Design (Amendment) Act, 2019 comes into force.
Clause 34 inserts a Schedule after section 41 containing the names and particulars of the National Institutes of Design.
The Financial Memorandum mentions that the establishment of the new Institutes in Andhra Pradesh, Madhya Pradesh, Assam, and Haryana will incur an expenditure of approximately Rs. 434 crore. The non-recurring expenditure is estimated to be Rs. 336.72 crore, and recurring expenditure is estimated to be Rs. 97.28 crore.
The Memorandum Regarding Delegated Legislation states that Clauses 24 and 25 amend sections 29 and 30 of the Act, respectively, to confer powers on the National Institutes of Design in the States mentioned above to frame Statutes and Ordinances.
