The Controladoria-Geral da Uniu00e3o (CGU) has sanctioned a private company and confirmed previous decisions that punished companies for fraud in tenders and contracts of the former public company Valec and the state-owned Eletronuclear. The decisions were published in the Diu00e1rio Oficial da Uniu00e3o (DOU) on April 10, 2024.
The CGU found that three companies, SPA Engenharia Indu00fastria e Comu00e9rcio Ltda, Egesa Engenharia S.A, and CMT Engenharia Eireli, participated in a cartel in Valec's tenders and contracts, resulting in the payment of over R$ 9 million in bribes to public agents. The companies were punished with the declaration of inidoneidade for licensing and contracting with public administration.
The CGU also investigated the Empresa Brasileira de Engenharia S.A, which acted concertedly with other companies to frustrate the competitiveness of a tender for the construction of the Angra 3 nuclear power plant, and was sanctioned with a fine of R$ 36.363.406.20.
In another case, the Chemtrade Brasil Ltda company recognized its responsibility for acquiring confidential information irregularly and had its request for anticipatory judgment deferred by the CGU, resulting in a fine of R$ 2.033.513.50.
Companies that are found to be inidoneita may be inscribed in the Registro de Empresas Inidu00f4neas e Suspensas (CEIS) if they do not appeal the decision or if their appeal is unsuccessful.
